When Advice Becomes the Answer — A Question of Process

From open guidance to prepared response — how governance advice is applied in practice.

A timeline of declarations, roles, and events, drawn from publicly available information.
Those articles did not seek to reach conclusions.
They set out what is known.
This article turns to the next stage:

The Question Put to the Board (see full text below)

At the meeting of the Health and Adult Social Care Scrutiny Board on 16 September 2025, those issues were brought directly into the room.
A deputation set out:

the relationship between Councillor Sally Tomlinson and Age UK Solihull
the existence of Council contracts
and the timing of entries in the Register of Interests
It then asked a straightforward question:
👉 whether recusal — and withdrawal from discussion — was required

And if not, that the objection be formally recorded and referred for further advice.
The question was clear.
It arose from matters already set out in the public record.

The July Position
Two months earlier, in July, the issue of potential conflicts had been addressed in general terms.
The Monitoring Officer, present in the room, was asked how members should approach situations where interests may arise.
The response was given openly.

What Was Said
The emphasis was clear.
Members should act in the interests of transparency.
And ultimately:
“it’s a matter for them to decide from their conscience as to whether or not they can continue to take part in that discussion”
The position expressed was one of principle:

declare interests
be transparent
exercise individual judgement

No specific case was being addressed.
The guidance was general.

The Council's Solicitor / Monitoring Officer was asked...

"But in the interest of transparency, I would always advise any member who is involved in something to declare that as an interest. It's a matter for them to decide from their conscience as to whether or not they can continue to take part in that discussion."

A Change in Context
By September, the position had moved from general principle to a specific case.
The issue was no longer abstract.
It had been set out in detail through the deputation.
The circumstances were also different:

The Monitoring Officer was not present at the meeting
Councillor Tomlinson, who had not been present in July, was present and responding

However, correspondence shows that:

advice had been provided in advance
and wording had been suggested for use in response

The ResponseWhen the deputation was read out, Councillor Tomlinson responded.
The minutes record that response in detail.

They show:

confirmation of the DPI
reference to prior discussions with the Monitoring Officer
an understanding of when participation is restricted
and a judgement that no agenda items required withdrawal

The response addressed the question.
But it also reflected a structure that had been set out beforehand.

From Advice to Answer
The structure and content of that response closely follow the wording set out in advance.
Key elements appear in the same sequence:

declaration
registration
prior advice
understanding of the rules
application to the agenda

The response delivered publicly reflects, in substance and structure, the guidance provided beforehand.

Two Forms of Advice
In July, advice was given:

publicly
in general terms
and left to the member to apply

By September, advice had become:

specific
structured
and formed in advance of the response
And the response was composed by the Monitoring Officer - Q. Its it possible to reconcile his July position from his September position?

Both are forms of guidance.
They are not the same in nature.

🔥 The Point of Tension
The July exchange set out a principle to be applied.
By September, the response appears not only to apply that principle --
but to have been shaped in advance.
This is not a conclusion.
It is a distinction in process.

A Question of Process
Where formal questions are raised in a public meeting, the process by which responses are formed matters.
In this case:

advice was given
wording was suggested
and a response was delivered that reflects that structure

Whether that reflects:

a routine approach
a standard practice
or something that warrants further consideration

is not immediately clear from the public record.

As set out throughout this series, the issue is not only compliance — but perception, consistency, and public confidence.
Where questions of governance remain unresolved, it is standard practice in some cases for independent review mechanisms to be considered.
